Terms of Service

These Terms govern your use of bourbonbeacon.com and The Bourbon Beacon mobile applications, operated by Quick Site Design LLC doing business as The Bourbon Beacon (collectively, “The Bourbon Beacon,” “we,” “us,” or “our”). By accessing or using the service, you agree to these Terms. You must be at least 21 years old to use the service.

Alpha changes, availability, and data

We may change the design, functionality, eligibility rules, inventory sources, delivery schedules, membership tiers, prices for future billing periods, supported devices, or any other part of the service. We do not promise that a particular feature will launch, remain available, work without interruption, retain data indefinitely, or be compatible with an earlier version. Maintenance, experiments, third-party failures, security concerns, legal requirements, or product decisions may cause partial or complete outages. When reasonably practical, we may provide notice of material changes, but emergency changes may occur without advance notice.

Inventory information is not a guarantee

The Bourbon Beacon organizes inventory and community information to help users plan a search. Inventory can change, contain delays or errors, and differ from what a store has available when you arrive. We do not guarantee that any bottle is available, that a store will sell it to you, or that you will find or purchase any item. Call the store before making a trip and obey all applicable laws and store policies.

Your submissions remain yours

You retain ownership of original tips, recommendations, photos, and other content you submit. You grant The Bourbon Beacon a nonexclusive, worldwide, royalty-free license to host, review, format, reproduce, publish, and display that content as needed to operate and promote the service. You confirm that you have the right to submit it and that it does not violate another person's privacy, copyright, trademark, or other rights.

Moderation and acceptable use

Every community submission may be reviewed, edited for clarity, approved, rejected, unpublished, or deleted. Do not impersonate others; post private personal information; harass store employees or hunters; submit fabricated sightings; manipulate inventory reports; or use the service to deceive, disrupt, or inhibit other users. Accounts that abuse the system may be suspended or banned, with or without advance notice.

Accounts, memberships, and communications

When Bourbon Beacon presents an account-agreement screen, you must affirmatively select the acceptance checkbox before continuing. We record the account, acceptance time, and the Terms and Privacy Policy versions shown so that your choice can be documented. If you do not agree, do not select the checkbox or continue using an account.

You are responsible for activity under your account and for keeping your account information current. We may suspend, restrict, or terminate access when we reasonably believe an account creates risk, violates these Terms, abuses the service, or must be restricted for legal or operational reasons. Transactional messages may be sent for account, moderation, billing, security, and service operations. Optional inventory and marketing communications can be managed in your account.

Paid Alpha memberships, renewal, and cancellation

A paid membership purchases access to the then-current Alpha service for the applicable billing period. It does not purchase ownership of any feature or create a promise that a particular feature, inventory result, delivery time, service level, or final product will remain available. Paying for Alpha access does not remove or reduce the risks described in these Terms.

Paid memberships and trials renew on the price and schedule disclosed at checkout until canceled. You may manage or cancel a Stripe membership through the secure billing portal in your account. Unless required by law or expressly stated in a written refund policy, fees already charged are nonrefundable, including when an Alpha feature is changed, interrupted, or removed. We will provide notice and a way to cancel when required before a material change to recurring terms takes effect.

Location, analytics, and privacy choices

Location is used to calculate nearby stores when you choose that feature. Precise location is not sold. We collect limited usage events to understand page visits, account creation, searches, and feature use. Email-open measurements are approximate because mail providers may block or prefetch images. Contact us to request access, correction, deletion, or other available privacy rights.

Third-party services and community information

Inventory sources, liquor stores, payment processors, email providers, maps, device platforms, and community contributors are independent third parties. We do not control and are not responsible for their availability, accuracy, conduct, policies, security, or decisions. Links and references do not imply endorsement. Community reports are unverified unless we expressly state otherwise.

Your responsibility and assumption of risk

You are responsible for confirming information before acting on it. Travel, store visits, purchases, alcohol possession, and alcohol consumption are undertaken at your own risk. The Bourbon Beacon does not sell, reserve, deliver, or guarantee alcohol. Never drink and drive, and follow all laws, store rules, safety guidance, and health advice applicable to you. The service is informational and is not legal, medical, financial, or professional advice.

Disclaimer of warranties

To the fullest extent permitted by law, the service and all information, features, memberships, communications, and content are provided “as is” and “as available,” with all faults and without warranties of any kind. We disclaim all express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, noninfringement, accuracy, availability, security, and quiet enjoyment. We do not warrant that the service will be uninterrupted, error-free, secure, or free from harmful components, or that defects or data loss will be corrected.

Limitation of liability

To the fullest extent permitted by law, Quick Site Design LLC, The Bourbon Beacon, and their owners, officers, employees, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, savings, data, goodwill, or opportunity; travel, fuel, lodging, time, or purchase costs; missed or unsuccessful purchases; store or third-party decisions; user submissions; service interruptions; security incidents; inaccurate, delayed, or lost data; or reliance on the service, even if advised that such harm was possible. These limitations apply to all users, including paying members and trial users, and regardless of the legal theory asserted.

To the fullest extent permitted by law, our total aggregate liability for all claims arising out of or relating to the service or these Terms will not exceed the greater of $100 or the amount you paid directly to The Bourbon Beacon during the 12 months before the event giving rise to the claim. Nothing in these Terms excludes or limits liability, warranties, remedies, or consumer rights that cannot lawfully be excluded or limited.

Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Quick Site Design LLC and The Bourbon Beacon from third-party claims, losses, liabilities, and reasonable costs arising from your submissions, your misuse of the service, your violation of these Terms or applicable law, or your infringement of another person's rights. This obligation does not apply to the extent a claim results from conduct for which applicable law does not permit indemnification.

Changes and contact

We may update these Terms as the service changes. Material revisions will be posted with a new effective date, and additional notice will be provided when required by law. If you do not agree to revised Terms, you must stop using the service and cancel any renewing membership.
